Terms of Service

Effective April 16, 2026

These Terms of Service ("Terms") govern your use of Alerne ("Alerne", "we", "us", "our"), an AI-powered course creation platform operated from Kazakhstan and available at alerne.com. By creating an account or using the service, you agree to these Terms. If you don't agree, don't use Alerne.

1. Who can use Alerne

You must be at least 13 years old (or the minimum age of digital consent in your country). You're responsible for your account, your credentials, and everything done under your account. One account per person.

2. What Alerne does

Alerne generates educational content — course plans, lessons, quizzes, flashcards, and chat responses — using AI models. We make the service available "as is" and do our best to keep it running, but we don't guarantee uptime, completeness, or that any particular feature will continue to exist.

3. AI content disclaimer

AI output can be wrong. Generated lessons and answers may contain factual errors, omissions, or outdated information. Alerne is not a substitute for a certified teacher, professional advice, or primary sources. Verify anything you intend to rely on.

You're responsible for evaluating the accuracy of generated content before acting on it. We're not liable for decisions you make based on AI output, and Alerne does not provide medical, legal, financial, or other professional advice.

4. Your content

Anything you type into Alerne — prompts, course topics, chat messages, uploaded files — is "Your Content". You retain ownership of Your Content. You grant us a worldwide, non-exclusive, royalty-free license to host, process, display, and transmit Your Content solely to operate and improve the service for you.

Don't submit content you don't have the right to use — no copyrighted material from others, no trade secrets, no personal data of third parties without their consent.

5. AI-generated output

Courses, lessons, quizzes, and other AI output generated for you ("Generated Content") are yours to use for personal learning. We don't claim copyright in Generated Content to the extent copyright can attach to it. Note that AI output is not generally copyrightable under US law, and similar outputs may be generated for other users.

6. Acceptable use

You agree not to:

  • Use Alerne to generate illegal, harmful, hateful, harassing, or sexual content involving minors
  • Attempt to extract prompts, model weights, or training data, or reverse-engineer the service
  • Scrape the service, send automated requests, or bypass rate limits
  • Resell, sublicense, or commercially redistribute Alerne or its Generated Content as a standalone product
  • Use the service to build a competing AI product or benchmark against Alerne without written permission
  • Upload malware, probe for vulnerabilities, or interfere with other users' accounts
  • Violate any applicable law or the terms of our AI providers

We may suspend or terminate your account for violations, with or without notice, and without refund.

7. Pricing, billing, and subscriptions

Alerne offers a free tier and a paid Pro subscription. Prices and plan details are on the pricing pageand are the authoritative source. We may change pricing with at least 14 days' notice; changes apply to your next billing period.

Pro is billed in advance on a recurring basis (monthly or yearly, as selected at checkout) by our payment provider. By subscribing, you authorize recurring charges to your payment method until you cancel.

Taxes may be added at checkout or billed separately depending on your location and local tax rules.

8. Cancellation and refunds

You can cancel at any timefrom your billing portal. When you cancel, your Pro access continues until the end of the current billing period, then stops. We won't charge you again.

All sales are final. We don't offer refunds for partial months, unused time, or forgotten subscriptions. Each generated course and lesson consumes real AI compute costs that we pay immediately, so subscription fees are not refundable once a billing period starts.

If you were charged because of a billing error, a duplicate charge, or a clear service failure on our side, contact contact@alerne.comwithin 14 days and we'll make it right.

EU / UK customers: When you start using Pro features (generating a course, unlocking a module), you are expressly requesting immediate performance of the digital service and you acknowledge that you lose the statutory 14-day right of withdrawal once that service has begun, in accordance with Directive 2011/83/EU and the UK Consumer Contracts Regulations 2013.

9. Beta features

Some features are labeled beta or experimental. They may break, change, disappear, or be moved behind a paywall without notice. Don't rely on them for anything important.

10. Suspension and termination

You can delete your account any time from settings. We may suspend or terminate accounts that violate these Terms, abuse the service, or pose risk to other users or to Alerne. On termination, your access ends and we may delete your data in line with our retention policy (see Privacy Policy).

11. Third-party services

Alerne relies on third-party providers (payment, email, analytics, AI models, hosting). Their outages or errors may affect the service. We'll work around issues where we reasonably can, but we aren't responsible for outages caused by upstream providers.

12. Disclaimers

ALERNE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF AI OUTPUT. YOU USE THE SERVICE AT YOUR OWN RISK.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALERNE'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR USD $50, WHICHEVER IS GREATER. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS OR DATA.

Nothing in these Terms limits liability that cannot be limited under applicable law (such as gross negligence, fraud, or statutory consumer rights).

14. Indemnity

You agree to indemnify and hold Alerne harmless from claims arising out of Your Content, your misuse of the service, or your violation of these Terms.

15. Changes to these Terms

We may update these Terms. Material changes will be announced by email or in-app notice at least 14 days before they take effect. Continuing to use Alerne after changes take effect means you accept the new Terms.

16. Governing law

These Terms are governed by the laws of the Republic of Kazakhstan, without regard to conflict-of-law rules. Disputes will be resolved in the competent courts of Kazakhstan, except where mandatory consumer-protection law in your country of residence gives you the right to bring proceedings in your home jurisdiction.
